General Terms and Conditions
for the delivery, installation, and commissioning of systems by sunday solar GmbH
1. Scope
1.1. Our General Terms and Conditions (hereinafter referred to as GTC) apply to the operational delivery and installation of a photovoltaic system (solar system) including accessories and wall boxes (charging stations for electric vehicles) in accordance with the contract concluded between us, sunday solar GmbH, and the customer.
1.2. sunday solar GmbH provides all deliveries and services within the framework of purchase contracts based on these GTC. Deviating conditions only apply if they have been expressly agreed upon in writing before the conclusion of the contract.
2. Conclusion of Contract
2.1. sunday solar GmbH offers an online configurator that allows customers to create a preliminary cost estimate for a photovoltaic system. Various service packages can be selected, and battery storage or wall boxes can be added optionally. The use of the online configurator is not mandatory for contacting us and obtaining an offer.
2.2. The examples shown in our configurator do not constitute binding offers. Furthermore, the calculated yields or profits expected from the installation of a system or the implementation of such a project are purely forecasts and may not reflect actual results.
2.3. The customer initially provides data relevant for the planning and installation of the system via a web form on our website. The customer can modify and review this data at any time before submitting it. Based on the data provided and a subsequent telephone consultation, the customer receives a tailored cost estimate, which can be confirmed as an order via the online configurator.
2.4. Unless otherwise agreed, an on-site appointment must take place before the customer receives an order confirmation to assess any additional costs for the construction project.
3. Payments
The payment conditions specified in the respective offer from sunday solar GmbH apply to the due date of payments. If the offer does not contain any payment terms, the total remuneration is due as follows: 50% upon completion of the roof installation and 50% upon completion of the electrical installation.
4. Obligations of sunday solar GmbH
sunday solar GmbH is obliged to deliver the ordered systems free of defects and to carry out the professional installation of the respective system in accordance with the project specifications.
5. Customer Requirements
5.1. The customer is responsible for obtaining any necessary approvals or permits for the installation of the solar system before the start of installation unless otherwise agreed with sunday solar GmbH.
5.2. The customer must ensure that the building on which the project is based can support the system and that the building has been checked for suitability, particularly the load-bearing capacity of the roof. The functionality of any existing lightning and surge protection system is assumed if available. Furthermore, a main earthing busbar must be present in the building. This requirement does not apply if the customer and sunday solar GmbH have expressly agreed otherwise.
5.3. The customer also declares that the building on which the system is to be installed is their property or that they have the authorization to conclude a contract for the installation of a PV system on the building. The customer also confirms that they will be the operator of the system.
5.4. After installation, the customer is required to accept the system in compliance with the applicable legal regulations.
6. Deliveries
Delivery of the goods as per the project is carried out by an external service provider. The shipping risk is borne by sunday solar GmbH if the customer is a consumer.
7. Warranty
The applicable statutory warranty provisions apply.
8. Manufacturer Warranties
The manufacturers of the PV components provide their own warranties. sunday solar GmbH does not adopt these warranties as its own. Customers may assert manufacturer warranties directly with the manufacturer. sunday solar GmbH can facilitate communication between the manufacturer and the customer.

9.1. The systems, components, or other goods ("goods") delivered or installed by sunday solar GmbH remain the property of sunday solar GmbH until full payment of the final invoice has been made.
9.2. In case of a breach of contract by the customer, particularly in the event of non-payment of the due amount, sunday solar GmbH is entitled to withdraw from the contract under legal provisions and demand the return of the goods based on the retention of title.
10. Liability
10.1. Our liability for contractual breaches as well as for torts is limited to intent and gross negligence. This does not apply to injury to life, body, and health of the customer, claims for the breach of cardinal obligations, and compensation for default damages (§ 286 BGB). In such cases, we are liable for any degree of fault.
10.2. The aforementioned exclusion of liability also applies to slightly negligent breaches of duty by our vicarious agents.
10.3. If our liability for damages is excluded or limited, this also applies to the personal liability of our employees, workers, staff, representatives, and vicarious agents.
10.4. We do not conduct examinations or calculations regarding the structural stability or load-bearing capacity of the building ground or structure on which our deliveries and services are based.
11. Right of Withdrawal
If the customer is a consumer, they have the following legal right of withdrawal:
You have the right to withdraw from the contract within fourteen (14) days without giving any reason. The withdrawal period is fourteen (14) days from the date of contract conclusion.
To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g., a letter sent by post or email) about your decision to withdraw from this contract.
To meet the withdrawal deadline, it is sufficient for you to send the notification regarding the exercise of the right of withdrawal before the withdrawal period expires.
